1. Introduction and Purpose
This Agreement governs your access to and use of telemedicine, teleconsultation, remote monitoring, and related digital health services ("Services") provided through www.ejinxmedsurg.health, in accordance with applicable Nigerian law, including the National Health Act 2014, the Medical and Dental Practitioners Act, the Nigeria Data Protection Act 2023, the Cybercrimes Act 2015, and the Evidence Act 2011. By ticking "I Agree" or otherwise accessing the Services, you confirm that you have read, understood, and voluntarily agree to be bound by this Agreement.
3. Voluntary and Informed Consent to Telemedicine
You acknowledge that telemedicine involves electronic transmission of your medical information, that a licensed Healthcare Provider will use independent clinical judgment to determine whether telemedicine is appropriate for your condition, and that this consent covers the mode of service delivery only — it does not replace your right to consent or object to any specific treatment recommended during a consultation.
4. Benefits and Limitations
Telemedicine offers improved access, reduced travel time, and continuity of care, but has limitations: the absence of a physical exam may limit diagnosis, connectivity issues may affect care quality, and a Provider may require an in-person visit at any stage. Telemedicine is not designed for medical emergencies.
5. Patient Responsibilities
You agree to provide accurate and complete information, promptly report changes in your condition, use the Services lawfully, keep consultations private, and seek in-person or emergency care when advised.
6. Emergency Situations
This Platform is not intended for medical emergencies. If you are experiencing an emergency (e.g. chest pain, severe bleeding, difficulty breathing, loss of consciousness, stroke symptoms, or suicidal thoughts), call the National Emergency Number (112) or go to the nearest hospital immediately.
7–8. Provider Qualifications, Prescriptions & Records
All Healthcare Providers must hold a valid Nigerian practising licence. Certain medications cannot be prescribed via telemedicine. An electronic medical record of your consultations will be created and retained, and you may request access or correction.
9. Data Privacy and Protection
Your health data is processed under the Nigeria Data Protection Act 2023 solely to provide the Services. It is stored with encryption and access controls, will not be sold, and cross-border transfers occur only with adequate safeguards. You have the right to access, correct, delete (subject to legal retention), object to, or withdraw consent for processing of your data, and to complain to the Nigeria Data Protection Commission (NDPC). Consultations are recorded only with your separate, explicit consent.
10. Confidentiality
Your health information is kept confidential and disclosed only with your consent, to deliver the Services, under legal compulsion, or to protect life.
12. Consent for Minors
Where the patient is under 18 or lacks legal capacity, this Agreement must be completed by a parent, legal guardian, or authorised next-of-kin.
13. Right to Withdraw Consent
You may withdraw consent to telemedicine, or to specific data processing, at any time. Withdrawal does not affect the lawfulness of prior processing and may limit the Platform's ability to continue serving you.
14. Electronic Signature
Your electronic acceptance (click-to-accept, typed name, or digital signature) is a valid and binding signature, and electronic records are admissible as evidence under Nigerian law.
15–17. Liability, Complaints, Governing Law
Platform liability is limited to proven negligence or wilful misconduct; individual Providers remain responsible for their own clinical advice. Care-quality complaints may go to the Patient Support team or MDCN; data complaints may go to the NDPC. Disputes are resolved by negotiation, arbitration/mediation, or the courts of Nigeria, under Nigerian law.
18. Acknowledgement
By accepting, you confirm you have read and understood this Agreement, understand telemedicine is unsuitable for emergencies, consent to the processing of your health data as described, have had the chance to ask questions, and voluntarily consent to receive care via telemedicine — with the right to withdraw at any time.
